Fossoway and District Community Council

As it is still not possible to hold physical meetings of the CC we are continuing to publish this description of what was discussed in our Virtual meeting, including any updates that we are aware of. Members of the Public are encouraged to comment on and question the items below, by email to moc.liamg|cc.yawossof#moc.liamg|cc.yawossof or via the CC’s Facebook page, which we will answer in our next meeting, be it virtual or physical, on Tuesday 2 February 2021.

Declarations of Interest: CCllrs Duffy, Cheape, Farquhar and Pye declared an interest in the first planning item discussed.
Membership: CCllr Rob Young had stepped down with immediate effect due to personal reasons. We thank him for his contribution over the past years and wish him all the best in the coming time.
The Council agreed to change the status of CCllr Marchant from Associate to Co-opted in light of the resignation of CCllr Young.
Planning: CCllr Duffy welcomed the three members of the public who were attending because of their direct interest in the first two planning matters being prioritised for consideration, which were ultimately for the District Council to determine. She then invited CCllr Marchant to outline the issues at stake, but undertook that those who had declared an interest in the first proposal (including herself) would take no part in the subsequent discussion.
New Applications:
20/01642/FLL CCllr Marchant advised that the proposal for this development at Easter Yetts hinged on whether or not it complied with Policy 19 of Housing in the Countryside and/or would result in the formation of a ribbon development of more than five properties. The objector attending then detailed his views as to why the proposed development did contravene the policy, after which the applicant similarly rehearsed his contention that the proposal was in accord with the policy. Cllr Barnacle then indicated that he had previously conversed with both the applicant and the objector, and that a PKC official would make a site visit before the Planning & Development Committee of the Council made a decision. In light of the foregoing and the acknowledgment that the policy was capable of different interpretation the Community Council resolved to submit to PKC a neutral comment.
20/01660/FLL Erection of a dwelling house at Land East of Lynwood, Main Street, Crook of Devon. An objector whose property neighboured the proposed development then voiced her objection, chiefly on the grounds that, if constructed, the new house would be only a little over one metre away from her gable end wall, which would inhibit possible future maintenance work in that area. After discussion the Council decided on a neutral comment on the basis that, whilst it welcomed the prospect of new affordable housing, it was concerned that the proposed building could impact adversely on access to the neighbour’s property.
20/01425/FLL: Extension to dwelling house at Duanbrig, Naemoor Road, Crook of Devon KY13 0UH. No comment.
20/01804/FLL: Erection of a dwelling house on land 30m east of Vine House. No comment.
Appeals:
19/01673/AML Land 100 metres north west of Schiehallion, Crook of Devon. CCllr Marchant had written to Mr S. Shand suggesting either a Zoom meeting or a physical meeting (when feasible) between him and representatives of the CC, so that possibilities could be discussed. As yet she had received no response.
Police Report: A single-axle Hobby Caravan was stolen from Hallhill Farm overnight on 2 December.
Minutes of Previous Meeting: The minutes of the March 2020 meeting (the last face-to-face meeting) will be signed off once normal meetings resume. Any significant decisions made since then will be brought to the next physical meeting to be formally recorded and ratified.
Matters Arising
Fossoway Area Transport/DRT: It was expected that a further meeting of the group would be held on 21 or 28 January.
Rumbling Bridge Gorge Bridge: CCllr Duffy had accepted a quotation in the sum of £5460 (including VAT but excluding costs) from Millard for flood risk assessment.
Crook Moss Travellers’ Site: Responses were awaited to letters sent to the new head of the Planning Department and the CEO.
Crook & Drum Growing Together: It was reported that at the meeting held on 7 December the wreath-making fundraiser was a success, with about 20 wreaths sold.
Blairingone War Memorial: The arrangements envisaged had proved not to be feasible and therefore an alternative solution would need to be sought, possibly via the Community Development Trust.
Fossoway Gathering Committee: It was reported that at the AGM normal meeting held on 2 December the group would investigate whether an event in September might be possible.
Crook of Devon Skate Park: Cllr Barnacle had written to Andy Clegg asking for a site meeting to identify a location in Crook of Devon.
Matters Arising with no update since last meeting:
Devonshaw Whinstone Quarry (FK14 7NH), Ivy Cottage Powmill , Cemetery Car Park Extension, Powmill in Bloom, Crook of Devon Skate Park, Fly Tipping, Flooding in Back Crook
Bank of Scotland Kinross Branch Closure: Cllr Watters said he understood that the March closure of the Kinross branch was now definitive. The CC expressed dismay at this prospect, which CCllr Marchant said she would explore in general terms and perhaps consult Liz Smith MP.
A977 Mitigation: Discussions about the introduction of 20 mph speed limits at places both on and off the main road were ongoing.
Community Development Trust: Cllr Barnacle said he hoped the 15 people who formed the Trust could meet virtually in the first week in February. He had suggested issues which might be discussed, including the adoption of Drummond Park in Crook of Devon.
New Business
Gritting of Roads: There was concern about inadequate gritting of roads and pavements in the current icy conditions. It was believed, however, that PKC was aware of the threats to public safety and was doing its best to address the situation in difficult circumstances. The CC had been in touch with PKC about St. Serf’s Road after a complaint by a resident: this road and the pavements had now been gritted.
Kinross Forum: CCllr Bruce-Jones reported on the meeting on 2 December which she and CCllr Cheape had attended on behalf of the CC. Matters discussed included contacts with PKC senior officers, especially in the context of the Travellers’ Site in Crook of Devon, the needs for affordable housing, community transport and speedwatch. Quarterly meetings of the Forum were intended.
Community Council Business
CCllr Pye reported that this year’s grant had been received from PKC, although the amount was 8p short for some reason, probably an administrative error.

Insurance: CCllr Bruce-Jones advised that the CC’s insurance policy was due for renewal. She undertook to deal with the matter in conjunction with CCllrs Pye and Duffy.
Data Control: CCllr Pye said that changed circumstances required the password for the Fossoway email account to be changed and said he would do this immediately.
